HOW DO I DETERMINE IF I AM ELIGIBLE FOR RELIEF UNDER MICHIGAN LAW?

A simple way to determine if you qualify to have your conviction set aside is to review the requirement checklist of Michigan Compiled Laws: Act 213 of 1965:

To be eligible to set aside a conviction, you must meet the following conditions:

  • You have no other convictions set aside in Michigan
  • You have only one conviction in Michigan
  • It has been 5 years since the conviction or the end of the term served
  • You were not convicted of a felony or an attempted felony punishable by life imprisonment.
  • You were not convicted of criminal sexual conduct in the second or third degree or assault with the intent to commit criminal sexual conduct
  • You were not convicted of traffic offenses (this includes driving on an expired/canceled license and DUIs)

If you answered YES to all of these questions, you may be eligible to seek relief under Michigan law.
