Mississippi Expungement Checklist

HOW DO I DETERMINE IF I AM ELIGIBLE FOR RELIEF UNDER MISSISSIPPI LAW?

A simple way to determine if you qualify to have your record expunged is to review the requirements of Mississippi SEC. 99-19-71:

To be eligible for felony record expungement, you must have no pending charges, and all requirements of conviction must be fulfilled including classes, probation, and the payment of fines and restitution and meet one of the following conditions:

  • You are a first time offender and have fulfilled your sentence and have no additional charges
  • You are a first time offender convicted of a misdemeanor with the exception of traffic violations (which includes DWIs)
  • You were arrested but not convicted of any kind of charge
  • You have a misdemeanor or felony charge “non-adjudicated”
  • Five years have passed with the successful completion of all terms and conditions of the sentence of conviction since you were charged with felony false pretense, felony bad checks, felony shoplifting, felony larceny, or felony malicious mischief
