New Jersey Expungement Checklist

HOW DO I DETERMINE IF I AM ELIGIBLE FOR RELIEF UNDER New Jersey LAW?

A simple way to determine if you qualify to have your conviction set aside is to review the requirement checklist of New Jersey Expungement Statutes 2C:52.

Felony Expungement

To be eligible to set aside a felony conviction, you must meet the following conditions:

  • Ten years have passed from the completion of probation, time served or fine payment
  • There are no charges pending and no conviction of a crime in any state
  • You have no convictions in New Jersey or any other state
  • You have no more than 3 disorderly violations
  • A dismissal of charges through pretrial intervention did not occur
  • You have no expungements in New Jersey or other states

If you answered YES to all of these questions, you may be eligible to seek relief under New Jersey law.

Misdemeanor Expungement

To be eligible to set aside a misdemeanor conviction, you must meet the following conditions:

  • Two years (five years for disorderly persons violation) have passed from the completion of probation, time served or fine payment
  • There are no charges pending and no conviction of a crime in any state
  • You have no convictions in New Jersey or any other state
  • You have no more than 3 disorderly violations (4 if disorderly persons violation)
  • A dismissal of charges through pretrial intervention did not occur if a disorderly persons violation
  • You have no expungements in New Jersey or other states if a disorderly persons violation

If you answered YES to all of these questions, you may be eligible to seek relief under New Jersey law.
